Tlumach Terms of Service

These Terms of Service ("Terms") govern your use of the Tlumach mobile application (the "App"), distributed via Google Play under the package com.tlumach.app. By installing, opening, or using the App you agree to be bound by these Terms.

If you do not agree, do not use the App.

1. The service

Tlumach is an AI-powered language-learning companion that generates single sentences calibrated to your level, plays back synthesised audio, and tracks your progress. It is not a substitute for professional language instruction, certification, or translation services.

2. Eligibility

You must be at least 13 years old to use Tlumach. By using the App you confirm that you meet this requirement.

3. Your account

You sign in with your Google account via Google Sign-In. You are responsible for keeping your Google credentials safe; anyone who can sign in with your Google account can access your Tlumach progress.

4. Subscriptions and one-time purchases

The App offers in-app digital products distributed through Google Play:

Type	What it grants
Spark subscription	A monthly allowance of fresh AI-generated sentences.
Pro subscription	A higher monthly allowance plus deeper drills.
Top-up packs	Additional one-time, never-expiring credits stacked on top of any active subscription.

All purchases are processed by Google Play. Tlumach never sees your payment-method details.

4.1 Subscription billing

Subscriptions auto-renew at the price displayed at purchase time, in your Google Play account's local currency, until cancelled.
You can change, pause, or cancel your subscription at any time in Google Play → Subscriptions or via Settings → Manage subscription inside the App.
Cancellation takes effect at the end of the current billing period; you keep access until then.
A grace period of up to 7 days is provided when a payment fails so you can update your payment method without losing service.

4.2 One-time top-ups

Top-up packs are charged immediately and added to your never-expiring credit balance.
They are non-refundable once consumed (because each spent sentence costs us real AI compute).

4.3 Refunds

Refunds for either subscriptions or top-ups are handled directly by Google Play according to Google's refund policy. You can request a refund from play.google.com/store/account/orderhistory.

If a refund is issued, your matching entitlement (subscription or unspent top-up credits) is removed automatically.

5. Acceptable use

You agree not to:

reverse-engineer, decompile, or attempt to extract source code or prompts from the App;
use the App to generate, store, or distribute illegal, defamatory, hateful, sexually explicit, or harassing content;
use scrapers, bots, or other automated means to interact with the App;
circumvent the entitlement system or share your account with others.

6. Generated content

Sentences and audio Tlumach produces are generated by an AI model. While we tune the system carefully, the output:

may occasionally contain factual or grammatical errors,
must not be treated as legal, medical, financial, or other professional advice,
may not be used for any purpose that violates the AI provider's acceptable-use policy.

7. Intellectual property

We retain all rights, title, and interest in the App, including its brand, design, code, and prompt engineering. You receive a personal, revocable, non-transferable, non-exclusive licence to use the App on devices you own.

8. Termination

We may suspend or terminate your access to the App if you violate these Terms or attempt to defraud the entitlement system. You may stop using the App at any time by uninstalling it and (optionally) deleting your account from Settings → Sign out → Delete account.

Termination does not automatically refund unused subscription time or top-up credits unless required by law.

9. Disclaimer of warranties

The App is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to the App is limited to the greater of (a) the amount you paid us through Google Play in the 12 months preceding the claim and (b) 5 EUR. We are not liable for indirect, incidental, consequential, special, or punitive damages.

11. Changes to these Terms

We may update these Terms when the service changes. Material changes will be announced in-app. Continued use after changes take effect means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the publisher's principal place of business, without regard to its conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction unless a mandatory consumer-protection law of your country says otherwise.
